Terms and Conditions of Use

General conditions for using StreamData's Snap platform.

This document constitutes an adhesion contract regulated by Law No. 19,496 on Consumer Protection in Chile. By registering and using the Snap SaaS, the Client accepts these terms, which complement specific written commercial agreements.

1. Description of Service

StreamData provides access to Snap, an AI-powered automated reporting platform. Snap operates by default in Read-Only mode and never alters, deletes, or overwrites the Client's original databases.

2. Registration & Corporate Domains

Use of the software requires a corporate account. Registration is strictly restricted to emails belonging to corporate domains validated and expressly authorized by the Client's organization.

3. Commercial Terms & Payment

Fees are governed by the signed commercial proposal or contract (usually in UF or CLP). Payments are made in advance. Non-payment authorizes StreamData to suspend software access after 5 business days' notice.

4. Limitation of Liability

We guarantee technical efforts to maintain platform availability, excluding downtime due to force majeure. StreamData is not liable for loss of profits, nor for business decisions taken by the Client based on Snap's reports.

5. Cybersecurity & Incident Response

We comply with Law No. 21,663. In the event of a security incident, we apply instant T+0 containment (blocking access, isolating containers) and notify the client within 24 hours and the National CSIRT within the regulatory 3 hours.

6. Intellectual Property

StreamData SpA is the sole owner of the software, algorithms, and infrastructure. The Client receives a non-exclusive, non-transferable license. The final generated reports belong entirely to the Client.

7. Exclusion of Right of Withdrawal

Due to the nature of SaaS reporting services and the required custom integrations, the right of withdrawal (retracto) under Article 3 bis of Law No. 19,496 is expressly excluded.

8. Dispute Resolution & Jurisdiction

Any dispute will first be resolved in good faith. If unresolved, the parties expressly submit to the jurisdiction of the Ordinary Courts of Justice of the commune and city of Santiago, Chile, under Chilean law.
